Agreement to Terms

By downloading, installing, or using any app developed by Greg McInnes ("I", "me", or "my"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use my apps.

License to Use

I grant you a personal, non-exclusive, non-transferable, revocable license to use my apps for your personal, non-commercial use, subject to these terms and any applicable app store terms (such as Apple's App Store Terms of Service).

You may not:

• Copy, modify, or distribute the app or its content
• Reverse engineer, decompile, or disassemble the app
• Remove any copyright or proprietary notices
• Use the app for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any services or systems

App Availability and Changes

I reserve the right to modify, suspend, or discontinue any app or feature at any time without notice or liability. I do not guarantee that apps will be available at all times or will function without errors or interruptions.

Apps may be updated periodically to add features, fix bugs, or improve performance. Some updates may be required to continue using the app.

Premium Features and In-App Purchases

Some apps may offer premium features or in-app purchases. All purchases are processed through the Apple App Store and are subject to Apple's payment terms and refund policies. I do not have access to your payment information.

Premium features are granted on a per-device or per-account basis as specified in the app. Subscriptions, if offered, will automatically renew unless cancelled at least 24 hours before the end of the current period.

AI-Powered Features

Some apps (such as GreenGauge) use artificial intelligence to provide personalized insights and recommendations. These features:

• Are provided for informational purposes only
• May not always be accurate or appropriate for your specific situation
• Should not be considered professional advice
• Require transmission of your app data to third-party services (Firebase and OpenAI)
• May have usage limits or require an internet connection

You are solely responsible for evaluating and acting upon any AI-generated insights or recommendations.

Health and Fitness Disclaimer

Apps related to health, fitness, or sports (including but not limited to Top Set Timer, Top Set Calculator, Top Set Training, and GreenGauge) are designed for informational and tracking purposes only.

These apps do not provide medical advice, diagnosis, or treatment.

Before starting any exercise program or making changes to your training, consult with a qualified healthcare provider or certified trainer. I am not responsible for any injuries, health issues, or other consequences resulting from use of my apps.

Calculations and estimates provided by fitness apps (such as one-rep max estimates or training recommendations) are approximations based on common formulas and should be used as general guidance only.

User Content and Data

You retain all ownership rights to any data you create or enter into my apps. As detailed in the Privacy Policy, most data is stored locally on your device. Some apps may offer optional iCloud sync or may transmit data to third-party services for specific features (see Privacy Policy for details).

You are responsible for maintaining backups of any important data. I am not liable for any data loss.

Intellectual Property

All apps, including their design, code, graphics, and content, are owned by me and are protected by copyright and other intellectual property laws. The apps are licensed to you, not sold.

Third-Party Services

Some apps may integrate with or rely on third-party services (such as course databases, AI services, or cloud storage). Your use of these services is subject to their respective terms of service and privacy policies. I am not responsible for the availability, accuracy, or functionality of third-party services.

Disclaimer of Warranties

My apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the app will be error-free or uninterrupted
• Warranties regarding the accuracy, reliability, or completeness of any content or data

Limitation of Liability

To the maximum extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, profits, or revenue
• Personal injury or property damage
• Interruption of use or loss of functionality
• Any damages resulting from use or inability to use the apps

In jurisdictions that do not allow the exclusion of certain warranties or limitations of liability, my liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold me harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of my apps or violation of these terms.

Children's Use

Most of my apps are not directed at children under 13. If an app is designed for children (such as educational games), it complies with applicable children's privacy laws and does not collect personal information. Parents and guardians are responsible for monitoring their children's app usage.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Changes to Terms

I reserve the right to modify these terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of my apps after changes are posted constitutes acceptance of the modified terms.

Termination

I may terminate or suspend your access to any app at any time, with or without cause, with or without notice. Upon termination, you must cease all use of the app and delete it from your devices.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
